Business Investigations, Fact Finding and Customized Research

With her extensive experience in fact-investigations and researching complex government information, Karen Winner conducts customized research for businesses, utilizing Freedom of Information requests, and other specialized research.

For example,  a Manhattan hotel owner was considering establishing a restaurant that would serve alcohol within the hotel. He hired Karen to research the laws and inherent risks involved in serving alcohol within the hotel’s premises, to gauge possible exposure to liability. She produced a report that provided information necessary for the hotel owner to make an informed choice on whether to move forward with the project.

In another example, a Manhattan businessman involved in a partnership dispute hired Karen to conduct research into whether the lawyer representing the businessman’s partners had a conflict of interest that would affect negotiations or litigation, to his detriment. Karen researched the issues, and presented her findings to the lawyer’s employer- law firm: the lawyer subsequently bowed out of active representation of the business partners in an arbitration proceeding.

In another example, a businessman thought he had registered the name of his company with the United States Patent and Trademark Office (USPTO) which grants the owner exclusive use of the mark nationwide. The name had been in use for more than 25 years. However, Karen’s research showed that not only had the name of his business not been registered, but his competitors had applied to register the same name with the USPTO, and were within just days of obtaining approval for exclusive use of that same name. Karen was able to stop the competitors from completing the registration process by opposing their application with the USPTO, and she successfully registered the businessman’s trademark, which then became valuable intellectual property when he eventually sold the business.
